Basic terms
Copyright (C) - the right assigned to the author of a work upon creation and cannot be transferred or alienated.
Exclusive right (ER) - the right to distribute works of art (for example: publication on paid/free resources) or to use it for material gain (for example: for merch). May be transferred or foreign.
Author - the person who created the work and has copyright in it.
Customer - the person who enters into a contractual relationship with the author on the basis of the commission work of art.
Commission - the conclusion of an oral contract based on the rules described in the TOS data.
Work - the object of art created by the author on the instructions of the customer.
Completed work - the work meets the conditions of the commission.
Sale - transfer of a completed work to the customer upon receipt of payment to the author.


Commission stages

1) When placing an commission, the author and the customer negotiate and agree on the terms of the commision:

1.1) Concept

1.1.1) Type of work ( digital art, traditional art, animation)
1.1.2) Format of the work ( headshot, halfbody, fullbody, reference)
1.1.3) Scope of work ( sketch, line, painting)
1.1.4) The idea of the work ( number of characters, characters pose, background, etc.)
1.1.5) Details ( presence of background, presence of certain objects, unique features of the character (wings, additional limbs, accessories, etc.))
1.6) References of characters included in the commission or a certain amount (upon individual request) of art with them with detailed! coloring


There is content that I don't draw:
- Feral pron
- Extreme fetishes (Scat \ Diapers \ Fat furs \ Hyper muscles, boobs or dicks \ Excessive Gore)
- Humans
- Excessive gore
- Robots \ mecha ( mech\cyber parts is ok)
The author has the right to refuse to complete a commission without giving a reason.By placing a commission you automatically agree to the rules stated above.


1.2) Deadline

1.2.1) Deadline is from one to three months.
1.2.2) The cost of additional payment for completing the work within the time frame limited by the customer.

1.3) Payment

1.3.1) Payment occurs at the time depending on the conditions specified in clause 1.2. If any conditions are not specified, the author reserves the right to his own interpretation regarding them.
1.3.2) Cost of the completed work
1.3.3) Type of payment ( full prepayment or payment in parts ( the first half before the sketch, the second after the sketch )). Payment plans are accepted if an item\commission will pass 500 €
1.3.4) Payment method: Payment is only via PayPal.

1.4) rights

1.4.1) EP applies only to the author ( additional fees are discussed individually )
1.4.2) Customer have all rights on commission for non-commercial use only. That is, the client can upload the art to his gallery, use it as an avatar, icons, print it on clothes/posters for himself and his friends. BUT he cannot sell it without the author's permission.

2) The procedure for providing the stages of creating a work

2.1) The author provides few sketches for final approval of the concept
2.2) The customer makes changes and agrees on the final concept
2.3) The author provides the customer with the stage of working with painting the character to check the correctness
2.4) The author provides the completed work to the customer


Commision rules

Deadlines may be extended for one of the reasons:
- Illnesses of the author or his relative
- Force majeure circumstances (fires, floods, etc.)
- Lack of technical capabilities to fulfill the commission
The author is obliged to warn the customer about the reasons that have arisen and provide new deadlines for completing the work. If agreed, the TOS continues; if there is no agreement, the author returns funds for the unfulfilled stages of creating the work.

Percentage ratio of the cost of the work by stages:

Sketch - 20%
Line - 40%
Painting - 60%
Shade - 80%
Detailing - 100%
When changing (including adding) one of the clauses of the conditions on the part of the customer after the stage of agreeing on the final concept, the customer immediately pays the author a penalty which depends on the complexity of the change in the work / in the amount of N% of the cost of the completed work before changes for each of points.
